1. Acceptance of TermsBy accessing or using the HomeWell AI platform, you agree to be legally bound by these Terms & Conditions. If you do not agree to these Terms, you must immediately cease all use of the Platform. These Terms apply to all users of the Platform, including homeowners and service professionals.
2. Description of ServiceHomeWell AI is a technology platform, not a contractor.
We do not directly provide home repair, maintenance, emergency response, or any skilled trade services. All physical services are provided solely by independent third-party contractors who are not employees, agents, or representatives of HomeWell AI. AI-generated cost estimates are provided for informational purposes only and do not constitute a formal quote.
3. Payment Processing — Third-Party DisclaimerHomeWell AI does NOT process, hold, transfer, escrow, or control any payments between Customers and Contractors.
All payment transactions are processed exclusively by Stripe, Inc. Any disputes related to payment processing, chargebacks, refunds, or fraud must be resolved directly with Stripe. HomeWell AI makes no guarantee that any payment will be successfully processed, that a Contractor will receive payment for services, or that a Customer's funds will be refunded in any circumstance.
4. Data, Storage & Liability for Data LossHomeWell AI is NOT liable for any loss, corruption, unauthorized access to, or deletion of your data.
We do not guarantee the availability, accuracy, completeness, reliability, or suitability of any data stored on the Platform. The Platform is provided "as-is" and "as-available." You are solely responsible for maintaining your own copies of any critical information entered into the Platform.
5. Independent Contractors — No Employment RelationshipAll service professionals who appear on the HomeWell AI Platform are independent third-party businesses. HomeWell AI does not supervise, direct, control, or guarantee the work performed by Contractors. Customers are strongly encouraged to independently verify contractor credentials, insurance, and licensing before authorizing any work.
6. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMEWELL AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES; PROPERTY DAMAGE OR PERSONAL INJURY ARISING FROM OR RELATED TO CONTRACTOR SERVICES; FAILURES OR DELAYS IN THIRD-PARTY PAYMENT PROCESSING; DATA LOSS, CORRUPTION, OR UNAUTHORIZED ACCESS TO USER ACCOUNTS.
